Conditions of Service

  1. The client understands that taking part in outdoor adventurous activities of any nature may be hazardous by its inherent nature. Therefore, by reading this form the client accepts a certain amount of risk to themselves. The client is aware and accept their risks and will be responsible for their own actions and involvement’s. The client understands that the provided instructor is insured in respect of legal liabilities and personal accident cover to the client.

  2. The client understands that without a signed and fully completed booking form, they cannot attend or take part on any course.

  3. These terms and conditions override and constitute the entire agreement between the client and Fluidtuition Paddlesports, regardless of any verbal discussions or client’s own terms and conditions. Any changes must be agreed and signed for, by both parties, in writing, prior to the course.

  4. If the client is under 18, the booking form must be filled out by a parent or legal guardian, who gives consent for their child to partake in the given activity stated on the booking form. This will constitute the consent for the child to partake in the given activity. All children under 18 MUST be accompanied, by their legal guardian or parent at all times during the course.

  5. In regards to the handling, storage and use or client personal data, we will follow the rules and regulation set out by the Data Protection Act 2018, c. 12. Clients have the right to have their personal data updated or removed at any time after it. Please ask for Data Protection Form for further details.

  6. The client understands that some data such as name, date of birth, email, postal address may be given to British canoeing in order to process courses and certifications. This complies with all rules under Data Protection Act 2018, c. 12.

Liability and Safety

  1. Insurance against person injury, accidents or loss whilst undertaking the course/service is the responsibility of the client. We accept no liability for such injuries, accidents, damage, or loss of any kind, including liability for death or personal injury, unless this is the result of negligence or deliberate act attributable to us.
  2. Clients must also not to be under the influence of any substance that could impair their own, the instructors, or the public’s health. Such examples are drugs, alcohol or illegal substances
  3. If the client has any concerns about their health in relation to partaking in adventurous activities, please consult a medical professional for advice. 
  4. Clients must abide by all health and safety instructions and regulations given by instructors at all times and are required to wear the necessary PPE as instructed by the instructors, which may include but not be limited to; Helmets, buoyancy aids, life jackets, knee pads etc. 
  5. Clients need to be able to swim 25 meters and confident being in open and/or moving water
  6.  Fluidtuition Paddlesports reserves the right to remove any persons from any course/tuition for failure to abide by any clause(s). 

Equipment Usage

  1. All client owned equipment being used is done so at the client’s own risk and must be suitable and safe for the day(s) ahead. Improper, poorly maintained or unsuitable equipment for the environment cannot be used on any course.
  2. Any damages caused by the client (including, but not limited to) to buildings, grounds, venues, vehicles, and or equipment belonging or not belonging to the client, caused willfully or accidentally, is the financial and legal responsibility of the client.
  3. If equipment borrowed/rented/loaned from Fluidtuition Paddlesports should be damaged beyond repair, lost, or broken by the client, they will pay the full MSRP cost for a replacement unit directly to Fluidtuition Paddlesports.
  4. Items that can be repaired will have the burden of the full cost of repair, be paid for in full, by the client, to Fluidtuition Paddlesports.
  5. Equipment is not for usage without the presence of the owner.

Tuition

  1. We shall provide the agreed tuition, as per booking forms, to the client subject to the booking conditions. Any changes to this, or additions, to the specified tuition, or conditions must be agreed in writing by us and the client at a minimum of 5 days prior to the course start date.

  2. Changes to the tuition may be made at any time which is necessary to comply with additions or unforeseen health and safety guidelines or other statutory requirements.

Fees/Booking

  1. Once a booking form has been submitted digitally or physically, the client is responsible to pay a minimum of a 50% deposit if booking is made more than 28 days before course start date; or 100% deposit is required if booking is less than 28 days before course start date. This shall secure the booking. All payment to be made via bank transfer (see Invoice for payment details) or cash if agreed in advance.

    • Full payment of outstanding monies is required no less than 14 days before the indicated start date on the invoice. Failure to pay in full 14 days prior to course start shall result in the booking being treated as being canceled by the client.

    • We have the rights to claim interest on the monies unpaid after the course has finished at Bank of England rates.

    • Anyone booking for a group must enclose individual signed booking forms for each participant and return them together.

    • The first £50 of any booking will be classed as a non-refundable deposit.

  2. Course dates may be changed by the client, these must be submitted 28 days before the course start If less than 28 days then this will be subject to a £20 administration fee.

Cancellations by Provider

  1. Courses/Services/Tuition may have to be cancelled, postponed, or rearranged, at short notice due to matters beyond our control i.e., strong winds, illness of providers, unsuitable temperatures, unsuitable conditions, or insufficient numbers for the course to run.

    • Clients are entitled to a full refund or a change of course dates due to these matters only.

    • When possible, refunds are to be issued within 14 days’ after receiving notice of cancellation from us. No interest is applicable due to late refunds.

  2. Fluidtuition Paddlesports are not liable for any costs the client has encored in travel, accommodation, equipment hire(s), or any other matter, for any reason.

  3. Any persons removed from a course by us has no right to a refund or compensation of any kind.

  4. We thoroughly recommend clients take out their own cancellation, and personal accident insurance.

Cancellations by Client(s)

  1. Course fees upon cancellations are applicable on the following rates;

    • If the client cancels more than, but not including 14, days before the star date of the course for any reason the non-refundable deposit shall be forfeited. Any further monies paid will be returned.

    • If the client cancels less than, and including, 14 days before the start date of the course, all paid monies are forfeited.

  2. Notice of cancellation shall be acknowledged within 5 days, and the booking stands until the clients has received such acknowledgement.

Wording

  1. The wording used within this document can be summarized as the following;

    • “We” or “Us” or “Our” or “Instructor” or “Fluidtuition Paddlesports” or “Operator” = Refers to Aaron Sampson, trading under the name of Fluidtuition Paddlesports.

    • “Course” or “Service” or “Tuition” = the purchased services being provided by Fluidtuition Paddlesports to a client.

    • “You” or “client” refers to the individual who is, receiving services from Fluidtuition Paddlesports.
